Terms of Service

1. Agreement to Terms

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. Your access is conditioned on your continued compliance with these Terms.

2. License Grant

Subject to your compliance with these Terms and payment of the applicable subscription fee, Apex Engineer grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to use the Software on devices you own or control, for your own use as permitted by your chosen plan. All rights not expressly granted in these Terms are reserved.

3. Piracy, Cracking and Prohibited Conduct

You must not, and must not attempt to, directly or indirectly:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or architecture of the Software.
• Circumvent, disable, bypass, defeat, or interfere with any licensing, authentication, digital rights management (DRM), copy protection, or other technical protection measures of the Software.
• Crack, patch, keygen, modify, tamper with, or create derivative works of the Software, including altering licence checks, feature flags, subscription validation, or usage limits.
• Share, distribute, publish, sell, resell, rent, lease, sublicense, or otherwise transfer your account, credentials, subscription, or licence to any third party, including ‘family sharing’ or team plans beyond the number of seats included in your plan.
• Access the Service with bots, scrapers, or automated scripts to harvest data, pricing, or content.
• Use the Software to build, train, or develop a competing product or service.
• Interfere with the integrity or security of our servers, networks, or databases, or attempt to gain unauthorised access to them.
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices in the Software.

4. Consequences of Violation and Enforcement

We actively monitor for unauthorised use. If we suspect or confirm that you have violated these Terms — including any attempt to crack, share, or tamper with the Software — we may, at our sole discretion and without prior notice: suspend or terminate your account and access; void paid subscriptions and refuse refunds; block your devices or payment details; take civil legal action, including claims for damages and lost licence revenue; and report unlawful conduct to the relevant authorities. Any licence, account, or subscription obtained through cracking, sharing, or other unauthorised means is void and grants no right to use the Service.

5. Accounts and Your API Keys

Some features require you to connect your own API keys for third-party AI providers. You are solely responsible for maintaining the confidentiality of your credentials, for all activity that occurs under your account, and for any charges billed to you by third-party providers. Notify us immediately if you suspect unauthorised use of your account.

6. Fees, Billing and Cancellation

Subscriptions are billed monthly in advance at the prices displayed on our pricing page. You may cancel at any time; access continues until the end of the current billing period. Fees are non-refundable except where required by applicable law. We may change prices prospectively with reasonable notice.

7. Acceptable Use

You agree to use the Software lawfully and only for its intended purpose: live race support in supported simulators. You may not use the Software in any way that violates applicable law, the rules of a racing service, or the rights of third parties.

8. Intellectual Property

The Software, including its design, branding, audio, algorithms, and documentation, is the exclusive property of Apex Engineer and its licensors. Nothing in these Terms transfers any ownership to you.

All data produced while using the Software — including telemetry, strategy plans, inputs and settings — belongs to you. The Software runs entirely on your device: this data is never sent to, stored on, or processed by any server operated by Apex Engineer. We do not operate data servers for user information and never see your telemetry or racing data.

If you connect your own API keys to third-party AI providers, data goes directly from your device to those providers under their own terms — never through us. Payments are handled by Lemon Squeezy, a third-party payment processor; we do not store your payment details.

9. Third-Party Services

The Software integrates with third-party services, including AI providers, SimHub, and Lemon Squeezy for payment processing. We are not responsible for those services. You are responsible for complying with their terms and for any charges they apply.

10. Disclaimer of Warranties

The Software is provided ‘as is’ and ‘as available’, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or that race advice will always be correct. Racing guidance is informational and does not guarantee results.

11. Limitation of Liability

To the maximum extent permitted by law, Apex Engineer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or racing results, arising out of or related to your use of the Software. Our total aggregate liability shall not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the ‘Last updated’ date. Material changes will be announced with reasonable notice. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access at any time if you breach these Terms, particularly the prohibited conduct described in Section 3, with immediate effect and without prior notice. Upon termination, your right to use the Software ends immediately.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in your country of residence. Any dispute shall be resolved through the courts of competent jurisdiction.
